1. Purpose and Scope
This Acceptable Use Policy ("AUP") governs your use of the iPractis platform (https://www.ipractis.com/) and all associated services provided by iPractis LLC ("iPractis," "we," "us," or "our"). This AUP is incorporated into and forms part of our Terms of Service. All Users of the Platform, including those acting in a Student capacity, those approved as Tutors, and visitors, are required to comply with this AUP. iPractis uses a unified account system where Student and Tutor features exist within a single account. Violation of this AUP may result in the revocation of Tutor status, suspension, or termination of your account and access to the Platform.
2. General Conduct Standards
All Users of the iPractis Platform agree to:
- Treat all other Users with respect, dignity, and professionalism at all times.
- Communicate in a courteous, constructive, and non-threatening manner.
- Respect the intellectual property rights of iPractis and other Users.
- Use the Platform only for its intended purpose of facilitating tutoring and educational services.
- Provide accurate, truthful, and up-to-date information in all profiles, communications, and interactions.
- Comply with all applicable local, state, national, and international laws and regulations.
3. Prohibited Conduct
The following activities are strictly prohibited on the iPractis Platform:
3.1 Harassment and Abuse
- Harassing, bullying, intimidating, or threatening any User.
- Using offensive, discriminatory, or hateful language based on race, ethnicity, national origin, gender, gender identity, sexual orientation, religion, disability, age, or any other protected characteristic.
- Stalking or repeatedly contacting a User after they have requested no further communication.
- Engaging in any form of sexual harassment, including unwelcome sexual advances, requests for sexual favors, or other verbal or visual conduct of a sexual nature.
- Any conduct that creates an unsafe or hostile environment for any User, particularly minors.
3.2 Fraudulent and Deceptive Practices
- Creating fake accounts, impersonating other individuals, or misrepresenting your identity, qualifications, or affiliations.
- Posting false, misleading, or fraudulent reviews, ratings, or testimonials.
- Attempting to manipulate the Platform's ranking, search, or recommendation algorithms.
- Engaging in any scheme to defraud other Users, iPractis, or any third party.
- Using the Platform for money laundering, pyramid schemes, or other illegal financial activities.
3.3 Circumvention of Platform Rules
- Soliciting or attempting to conduct transactions with other Users outside the iPractis Platform to avoid Service Fees.
- Sharing contact information (email, phone number, social media handles) for the purpose of transacting outside the Platform.
- Creating multiple accounts to circumvent account restrictions, bans, or fee structures. Each User is permitted only one unified account.
- Using the Platform to advertise or promote external services, products, or competing platforms.
3.4 Harmful or Illegal Content
- Uploading, posting, or transmitting any Content that is illegal, obscene, pornographic, defamatory, libelous, or otherwise objectionable.
- Sharing content that promotes violence, self-harm, terrorism, or illegal activities.
- Distributing malware, viruses, spyware, or any other harmful software or code.
- Sharing copyrighted material without proper authorization from the rights holder.
- Posting spam, unsolicited advertisements, or promotional material not authorized by iPractis.
3.5 Technical Abuse
- Attempting to gain unauthorized access to the Platform, other Users' accounts, or any connected systems or networks.
- Using automated tools, bots, scrapers, or crawlers to access or collect data from the Platform without express written permission.
- Interfering with the proper functioning of the Platform, including overloading, flooding, or "denial of service" attacks.
- Reverse engineering, decompiling, or disassembling any portion of the Platform's software or technology.
- Circumventing, disabling, or interfering with any security features or access controls of the Platform.
3.6 Child Safety
Given that minors may use the iPractis Platform with parental consent, the following additional rules apply:
- Any behavior that exploits, harms, or endangers minors is strictly prohibited and will be reported to the appropriate law enforcement authorities.
- Users must not engage in grooming behavior or attempt to establish inappropriate relationships with minor Users.
- Tutors working with minor Students must maintain professional boundaries at all times.
- Sharing of any content depicting minors in a sexual or exploitative manner is strictly prohibited and will be reported to the National Center for Missing and Exploited Children (NCMEC) and law enforcement.
4. Tutor-Specific Standards
In addition to the general conduct standards, Tutors on the iPractis Platform must adhere to the following:
- Provide tutoring services to the best of their ability and in a professional manner.
- Accurately represent their qualifications, experience, and teaching capabilities.
- Set and maintain an accurate availability schedule on the Platform at all times. Availability must reflect only the time slots during which the Tutor is genuinely able to conduct Sessions. Publishing false, speculative, or misleading availability in order to appear more prominently in search results or for any other reason is strictly prohibited.
- Keep availability up to date and promptly remove or modify time slots that are no longer available, ensuring Students are not able to book Sessions the Tutor cannot honor.
- Prepare adequately for scheduled Sessions and deliver content as described in their profile or lesson offerings.
- Honor all Sessions confirmed within their published availability and provide at least twenty-four (24) hours' notice of any cancellations through the Platform.
- Maintain appropriate professional boundaries with all Students, especially minors.
- Not record Sessions without the explicit consent of all participants. iPractis does not record Sessions; however, individual Users are prohibited from recording any Session content (audio, video, or screen) without obtaining prior written or verbal consent from all other participants in the Session.
- Respect the confidentiality of Student information obtained through the Platform.
5. Reporting Violations
iPractis encourages all Users to report any violations of this AUP. You may report violations by: (a) using the reporting feature within the Platform; (b) emailing us at legal@ipractis.com; or (c) contacting our customer support team. All reports will be reviewed promptly and handled confidentially to the extent possible. iPractis prohibits retaliation against any User who reports a violation in good faith.
6. Enforcement and Consequences
iPractis reserves the right to investigate any suspected violations of this AUP and to take appropriate action, which may include:
- Issuing a warning to the offending User.
- Temporarily suspending the User's account and access to the Platform.
- Permanently terminating the User's account.
- Removing or disabling access to any Content that violates this AUP.
- Withholding or forfeiting any pending payments to the offending User.
- Reporting illegal activities to the appropriate law enforcement authorities.
- Pursuing legal action to recover damages or seek injunctive relief.
The severity of the enforcement action will be determined by iPractis in its sole discretion, taking into account the nature and severity of the violation, the User's history of violations, and the potential harm to other Users or to iPractis.
7. Appeals Process
If your account has been suspended or terminated as a result of an AUP violation, you may appeal the decision by contacting legal@ipractis.com within thirty (30) days of the enforcement action. Your appeal should include a detailed explanation of why you believe the enforcement action was unwarranted. iPractis will review your appeal and respond within a reasonable timeframe. The decision of iPractis on appeal shall be final.
8. Changes to This Policy
iPractis reserves the right to modify this AUP at any time. Changes will be posted on the Platform with a revised "Effective Date." Your continued use of the Platform after any changes constitutes your acceptance of the updated AUP.
