While we strive to provide accurate and up-to-date information, iPractis makes no representations or warranties of any kind, express or implied, regarding the completeness, accuracy, reliability, suitability, or availability of the Platform or the information, products, services, or related materials contained therein for any purpose. iPractis is an online marketplace that connects Students with independent Tutors. iPractis does not provide educational, academic, professional, or any other form of advice. The tutoring services available through the Platform are provided by independent Tutors and not by iPractis. iPractis does not guarantee the quality, accuracy, completeness, or effectiveness of any tutoring services, teaching methods, educational materials, or advice provided by Tutors through the Platform. Students should exercise their own judgment and, where appropriate, seek qualified professional advice before making decisions based on information or services obtained through the Platform.
iPractis reviews qualifications and credentials submitted by Tutor applicants as part of the Tutor Application process; however, iPractis does not independently verify the authenticity of submitted credentials, does not conduct identity verification, and does not perform criminal background checks on any Users, including Tutors. iPractis does not guarantee the accuracy or completeness of any Tutor's self-reported qualifications, certifications, degrees, experience, or expertise. The display of a Tutor's profile, ratings, reviews, or credentials on the Platform does not constitute an endorsement, recommendation, or certification by iPractis of that Tutor's abilities, qualifications, character, or fitness for any particular purpose. Students are solely responsible for evaluating and selecting Tutors. Parents and legal guardians of minor Students bear full responsibility for supervising their child's interactions on the Platform.
iPractis and its Tutors do not guarantee any specific learning outcomes, academic results, test scores, grades, certifications, or other educational achievements. Learning outcomes depend on numerous factors, including but not limited to the Student's effort, aptitude, prior knowledge, consistency, and individual circumstances. Any testimonials, success stories, or case studies shared on the Platform represent individual experiences and are not guarantees of future results.
The Platform may contain links to third-party websites, services, or resources that are not owned or controlled by iPractis. iPractis has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. The inclusion of any link on the Platform does not imply endorsement, approval, or recommendation by iPractis. You acknowledge and agree that iPractis shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any third-party content, goods, or services.
iPractis does not warrant that the Platform will be available at all times or that access will be uninterrupted, timely, secure, or error-free. The Platform relies on third-party services, including Google Meet for live video Sessions and Stripe for payment processing. iPractis is not responsible for the availability, performance, or reliability of these third-party services. Sessions are conducted via Google Meet and are not recorded by iPractis. iPractis does not store, retain, or have access to any audio or video content from Sessions. iPractis shall not be liable for any interruptions, delays, or failures of the Platform or third-party services, including but not limited to interruptions caused by: (a) scheduled or unscheduled maintenance; (b) server failures; (c) internet connectivity issues; (d) Google Meet outages or disruptions; (e) force majeure events; or (f) actions by third-party service providers.
iPractis facilitates payments between Students and Tutors through its integrated payment system. iPractis is not a bank, financial institution, or money services business. Payments are processed by Stripe, a third-party payment processor, and are subject to Stripe's terms and conditions. iPractis does not provide financial, tax, or accounting advice. Tutors are solely responsible for their own tax obligations, including reporting and paying any applicable income taxes on earnings received through the Platform. Users should consult with qualified financial or tax professionals regarding their individual circumstances.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, iPRACTIS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE PLATFORM; ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PLATFORM, INCLUDING TUTORS; ANY CONTENT OBTAINED FROM THE PLATFORM; UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT; OR ANY TUTORING SERVICES OR EDUCATIONAL OUTCOMES RESULTING FROM THE USE OF THE PLATFORM.
You agree to defend, indemnify, and hold harmless iPractis and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your use of the Platform, your violation of these disclaimers or any applicable terms, or your violation of any rights of a third party.
This Disclaimer shall be governed by and construed in accordance with the laws of the State of Wyoming, United States of America, without regard to its conflict of laws principles. Any disputes arising from or related to this Disclaimer shall be subject to the exclusive jurisdiction of the state and federal courts located in Sheridan County, Wyoming.
